The digital influencer Daniel Augusto Bicalho Ferreira de Souzaknown as MC Dugaoo, was sentenced to four years and one month in prison open regime for selling fake iPhones made from clay.
The decision was handed down by the 4th Criminal Court of Belo Horizonte and was motivated by the complaint of a couple who purchased the “devices” after negotiating through a sales website. We even talked about this case last April.
According to the judge’s ruling Vítor Marcos de Almeida SilvaMC Dugaoo used his popularity and credibility on social media — on which he accumulated more than 300 thousand followers — to gain the trust of victims and facilitate the scam.
He allegedly arranged a meeting with the couple in the Camargos neighborhood, in Belo Horizonte, and upon delivering the sealed package, threatened the victims, claiming to be armed and demanding the transfer of R$13,000 via Pix.
Frightened by the threat that the influencer was armed, the couple made the payment. After he left the place, they opened the package and discovered that, instead of the promised cell phones, there were clay bars to imitate the devices.
According to the conditions of the open regime, MC Dugaoo will be able to work and study during the day, but must retire at night and on days off. He was also forced to refund the amount of R$13,000 to the couple.
The Influencer Advocacy declared to g1 who will appeal the decision, stating that no compelling evidence was presented about the threat, claiming that the accused did not carry weapons. The defense also argued that security camera images show that the negotiation was peaceful.

Lawyer interview questions and answers
**Interview with Legal Expert on the MC Dugaoo Case**
**Interviewer:** Good evening, and welcome to tonight’s segment. We have a special Alex Reed with us, legal expert Dr. Maria Santos, to discuss the recent sentencing of digital influencer MC Dugaoo for selling fake iPhones. Thank you for joining us, Dr. Santos.
**Dr. Maria Santos:** Thank you for having me. It’s a pleasure to be here.
**Interviewer:** Let’s dive right in. MC Dugaoo was sentenced to four years and one month in prison for this scam. What were the legal grounds for his sentencing?
**Dr. Maria Santos:** The case against MC Dugaoo revolved around fraud. The court found that he deliberately misled consumers by selling fake products while leveraging his social media influence to gain their trust. The judge, Vítor Marcos de Almeida Silva, emphasized that his actions were particularly egregious because they exploited his online reputation.
**Interviewer:** It’s reported that he had over 300,000 followers. How do you think this played into the court’s decision?
**Dr. Maria Santos:** His substantial following indicates a level of trust and credibility that he misused for personal gain. The court likely viewed this as an aggravating factor, suggesting that the larger the audience, the greater the responsibility to act ethically. Selling clay iPhones, in this case, was a significant betrayal of that trust.
**Interviewer:** Can you tell us more about the impact of social media on cases like these?
**Dr. Maria Santos:** Social media can significantly amplify the reach of fraudulent activities. Influencers often hold a high level of sway over their followers, which can lead to rapid dissemination of scams. In this instance, individuals might have felt assured by Dugaoo’s online persona, which compounded the potential for harm when they made the purchase.
**Interviewer:** What should consumers keep in mind to protect themselves from similar scams?
**Dr. Maria Santos:** Consumers should always verify the authenticity of products and the sellers, especially when buying through social media platforms. It’s crucial to look for reviews, check for official websites, and be skeptical of prices that seem too good to be true. Research is key in today’s digital age where scams are prevalent.
**Interviewer:** Thanks for those insights, Dr. Santos. what message do you think this case sends to other influencers?
**Dr. Maria Santos:** This case serves as a stern warning that influencers must conduct their business with integrity. Misuse of their platform for fraudulent activities not only affects victims but can lead to severe legal consequences. Transparency and honesty are essential in maintaining their credibility and trust.
**Interviewer:** Thank you, Dr. Maria Santos, for sharing your expertise with us today. It’s vital that consumers are informed and aware of the potential dangers online.
