Justice Aminuddin Khan appointed as the first head of the 7-member constitutional bench

Federal Law Minister Nazir Tarar told Independent Urdu on Tuesday evening that Justice Aminuddin Khan has been appointed as the head of the Constitution Bench.

He said that the meeting of the Judicial Commission chaired by Chief Justice Yahya Afridi decided to establish a seven-member constitutional bench headed by Justice Aminuddin Khan.

All members attended the Judicial Commission meeting.

Under the two-point agenda, the issue of constitution bench in Supreme Court and establishment of secretariat for judicial commission was considered in the meeting.

The Federal Law Minister said that in the meeting of the Judicial Commission of Pakistan, the decision of the Constitutional Bench was made in the ratio of seven to five.

He said that in addition to Justice Muhammad Ali Mazhar, Justice Naeem Afghan, Justice Musrat Hilali, Justice Ayesha Malik, Justice Jamal Mandukhel and Justice Hasan Azhar Rizvi will be included in the seven-member constitutional bench.

Chief Justice Yahya Afridi, Mansoor Ali Shah, Muneeb Akhtar, Umar Ayub and Shibli Faraz opposed the name of Justice Aminuddin Khan as the head of the bench.

Rules will also be framed for the establishment of the Secretariat of the Judicial Commission.

Justice Aminuddin and Justice Ayesha Malik from Punjab, Justice Muhammad Ali Mazhar and Justice Athar Hasan Rizvi from Sindh, Justice Jamal Mandukhel and Justice Naeem Akhtar Afghan from Balochistan and Justice Musrat Hilali from Khyber Pakhtunkhwa have been included in the constitution bench.

The next meeting of the Judicial Commission will be held after two weeks.

This was the first meeting of the Commission after the enactment of the 26th Constitutional Amendment and the formation of the Judicial Commission.

After the approval of the 26th Constitutional Amendment on October 21, the Constitution Bench has been constituted for 60 days.

Earlier, according to media reports, two judges of the Supreme Court, Justice Mansoor Ali Shah and Justice Muneeb Akhtar, had written to the Chief Justice yesterday to form a full court bench on the constitutional amendment.

In the letter, the two judges called for the full court to hear the 26th Amendment case this week.

According to the text of the letter, the committee meeting held on October 31 decided to refer the 26th Amendment case to the Full Court, which was to be heard by the Full Court on November 4.

The letter further stated that despite the committee’s decision, no cause list was issued.

Both the judges had demanded the Chief Justice to convene a committee meeting on October 31. For not calling the meeting, the judges themselves called a meeting under Section 2, in which it was decided that the case against the 26th amendment will be heard by the full court on November 4.

The letter has also asked to place petitions against the 26th Amendment before the Full Court this week while also publishing the October 31 meeting minutes on the Registrar’s website.
