It was in May last year that the woman entered the home on Nesodden where the one-year-old grandson and parents lived. Without making contact with her son, who is the one-year-old’s father, she went up to the second floor to the room where the grandson was sleeping, and threw him out of the window so that he fell 4.3 meters onto the paving stones in the courtyard.
The one-year-old suffered serious head injuries, but suffered no lasting physical damage.
The grandmother has been mentally ill for several years, and the prosecution believes that she was not sane when she threw her grandson out of the window.
In February this year, she was sentenced to compulsory mental health care in Follo and Nordre Østfold district court, as well as to pay NOK 100,000 in compensation to the grandchild, but appealed.
She has both in the district court, and when the case went to the Eidsivating Court of Appeal this month, denied criminal guilt after being charged with attempted murder. She says that she does not remember anything from the incident, but does not deny that she threw her grandson out of the window.
Eidsivating has also come to the conclusion that the woman should be sentenced to compulsory mental health care. In addition, they are increasing the compensation for the grandchild to NOK 230,000.

**Interview with Legal Expert on the Nesodden Case**
**Editor:** Thank you for joining us today to discuss the recent case involving the grandmother who threw her one-year-old grandson out of a window. Can you start by outlining the key points of the case?
**Legal Expert:** Certainly. In May of last year, a grandmother entered her son’s home and, without any prior communication, went to where her grandson was sleeping and threw him out the window, resulting in serious head injuries. The grandmother has a history of mental illness, which was central to the court’s ruling. She was sentenced to compulsory mental health care and ordered to pay compensation, which has now been increased on appeal.
**Editor:** The court determined that she was not sane at the time of the act, despite her admitting to throwing the child. How does this affect public perception of justice in similar cases?
**Legal Expert:** This situation raises significant questions about accountability and mental health in criminal law. There’s a complex debate here—while many may sympathize with her mental health struggles, others might feel that throwing a child from a window should carry severe consequences, regardless of the perpetrator’s mental state.
**Editor:** It’s a challenging perspective. What do you think is the most contentious point in this case?
**Legal Expert:** The most contentious issue will likely be the balance between compassion for a person’s mental health and the safety of vulnerable individuals, such as children. Some may argue that this incident highlights the need for stricter measures to protect children, while others might emphasize the failures in mental health care that could have prevented such a tragedy.
**Editor:** Speaking of prevention, how should society approach cases involving mentally ill individuals who commit violent acts?
**Legal Expert:** This is where we need a societal dialogue. There should be a focus on early intervention and adequate mental health support systems while also ensuring that the legal system can effectively deal with those who pose a risk to others. The question remains: how do we protect potential victims while also caring for the mentally ill?
**Editor:** Definitely a complex issue. As we wrap up, what do you think our readers should consider when forming their opinions about this case?
**Legal Expert:** Readers should reflect on the implications of mental illness in the justice system. They might ask themselves: should mental illness be seen as a mitigating factor, or should the act of violence itself carry precedence in the eyes of the law? This case opens up a wider debate about accountability, justice, and compassion. It’s crucial that we engage in thoughtful discussion around these themes.
**Editor:** Thank you for sharing your insights. This certainly raises many important questions for our audience to consider.
