OGH ruling: Operators pay back network access fees

The Austrian Energy industry association announced this on Tuesday. Repayments will probably begin this year and customers will not have to take any action on their own.

In its ruling, the Supreme Court stated that the charging of network access fees is only permitted in certain cases – for example when expansion measures were taken to establish network access, according to the E-Wirtschaft announcement.

Who is entitled to reimbursement?

Entitlement to reimbursement therefore exists for all generation plants for which network access fees have been charged since the Renewable Energy Expansion Acceleration Act came into force, without the network operator incurring any direct expenses, for example in the form of structural measures or through strengthening the network infrastructure.

There are also cases in which these claims have already expired, but as part of a goodwill arrangement, these customers will also be reimbursed their money, the network operators said.
