The Attorney General’s Office (FGR) insisted, on October 22, 2024, that the remains of blood found on the Huertos del Pedregal farm, in Culiacán de Rosales, did correspond to Héctor Melesio Cuén Ojeda, leader of the Sinaloense Party ( PAS), elected federal representative and former rector of the Autonomous University of Sinaloa (UAS).

Alejandro Alberto Díaz Cruz, Control Judge of the Federal Criminal Justice Center of Culiacán de Rosales, Sinaloa, denied, on October 21, 2024, that the blood evidence found on the farm located in Huertos del Pedregal, in the capital of Sinaloa, corresponded to Cuén Ojeda, as stated, a day before, by the FGR.

Furthermore, the law enforcement institution asserted that the federal judge “failed to state” that the arrest warrant against Joaquín Guzmán López, “El Güero Moreno” – 38 years old and son of Joaquín Archivaldo Guzmán Loera, alias “El Chapo” ”- was for the alleged kidnapping of Ismael Mario Zambada García, alias “El Mayo”, 76 years old, as well as the crime of treason, and that there was no request from the Public Ministry of the Federation (MPF), for the murder of Cuén Ojeda.

“Federal Judge Alejandro Alberto Díaz Cruz has been communicating to the media, yesterday and today, that he denied an arrest warrant against Joaquín ‘N’ that the Federal Public Ministry requested, because he had no evidence, the October 5, about the possible blood prints of Dr. Héctor ‘N’,” the Prosecutor’s Office recalled.

“The Judge himself avoided informing that the Federal Public Ministry provided him with 78 (seventy-eight) pieces of evidence, which established illegal acts (kidnapping and treason) as well as the probability that Joaquín ‘N’ had committed them. ; which were more than enough to issue an arrest warrant against said individual; and that should have been considered and valued by the Judge, in accordance with what is stated in article 141, frac. III of the ]National Code of Criminal Procedures]CNPP”, indicated the Prosecutor’s Office.

“It is very important to point out that the Judge failed to state that the arrest warrant against Joaquín ‘N’ was for kidnapping and treason; and that there was no request from the Federal Public Ministry for the homicide of Dr. Héctor ‘N’; and that the blood data on the blood fingerprints of the same doctor were not, by any means, substantive to prove the kidnapping and betrayal of the country by Joaquín ‘N’,” said the FGR.

“As is already public and well-known, the blood evidence has already been examined and fully identified and will constitute evidence in the case of the homicide of said person. The Public Ministry of the Federation, after a hearing of more than eight hours, decided to withdraw its request, due to the above; and given that it is an institution of good faith, which acts in defense of justice, it will continue with the criminal procedure in a clear and transparent manner, reporting what is appropriate with respect, truthfulness and objectivity,” concluded the Prosecutor’s Office.

In an information card, the federal judge detailed, on October 21, 2024, that in the request for an arrest warrant against “El Güero Moreno” for the alleged kidnapping of “El Mayo”, the FGR presented an expert report on the which concluded that the samples collected at that place did not correspond to the Sinaloa politician.

“With respect to the informative note from the Federal Criminal Justice Center in Sinaloa, with residence in Culiacán, in which it states that the statement from the #FGR of last October 20 ‘does not correspond to reality’ (SIC)”, the law enforcement institution said in a statement issued later that day.

“In four paragraphs, said Center presents its points of view regarding an arrest warrant against Joaquín ‘N’, in the sense that ‘there is no situation of rejection by the Federal Judge of Culiacán’; when, according to the literal transcription of what was expressed by said Judge, it is the following,” added the FGR, whose owner is Alejandro Gertz Manero.

“Said Center states that ‘there is no situation of rejection by the Federal Judge of Culiacán’; when the literal transcription of what was expressed by said Judge is the following: ‘Consequently, it is considered that the person who should hear the request to issue an arrest warrant in this type of crimes is a Federal Judge in whose jurisdiction he resides, a Judge whose jurisdiction resides in a Maximum Security Prison (SIC)”, justified the Prosecutor’s Office.

“As for the ‘hematic evidence’ found at the site of the possible kidnapping, located on September 18, these were already surpassed by various evidence found on said property, expertly reported on last October 17, and in which found an undoubted coincidence of the genetic profile of Dr. Héctor ‘N’. The advances in this investigation will continue to be made known, as they are obtained,” concluded the FR.
