A fine of 40,000 euros in the ND for the case of the e-mail leak of emigrants

The total amount of 40,000 euros was imposed on ND as a fine by the Authority for the Protection of Personal Data (APDPH) for the case of the e-mail leak of emigrants to the former MEP of the ND, Anna Michele Asimakopoulou.

The completion of the investigation “showed” that the New Democracy party was not involved in the leak.

However, the Authority by its decision, which was taken by a majority (5-2), imposed a fine of 30,000 euros on the party as it was found that it did not take sufficient measures to protect personal data and an additional 10,000 euros, because the list was leaked by an employee. the former secretary of Apodimon of the ND Nikos Theodoropoulos.

At the same time, he fully exonerated the then Secretary General of the Ministry of the Interior, Michalis Stavrianoudakis, who resigned after the disclosure of the case, judging that a third person made the leak from the Ministry who, however, could not be located.

The file path

According to the decision, the disputed file was sent to the former secretary of Apodimon of the ND Nikos Theodoropoulos by the then Organizing Secretary of Self-Government and Crisis Management of the ND. Menio Koromilas, who allegedly claimed that he received it from the general secretary of the ministry, Mr. Stavrianoudakis.

However, this report was not confirmed by other evidence, resulting in the discharge of Mr. Stavrianoudakis. Following the … traces, the Authority concluded that M. Koromilas sent the file to N. Theodoropoulos acting as a private person and not as an executive of New Democracy, imposing a fine of 10,000 euros on him.

Then, according to the Authority, Mr. Koromilas sent the list to N. Theodoropoulos, who used it for statistical reasons regarding the May 2023 elections.

The majority considered that the processing of the statistics was done on behalf of the party, that is, Mr. Theodoropoulos acted as an employee of New Democracy. Thus, the Authority imposed a fine of 10,000 euros on New Democracy.

According to the Authority, although N. Theodoropoulos had to delete the file, he kept it for 6 months and then, acting as a private individual, sent it to Anna Michelle Asimakopoulou.

With this rationale, the Authority accepts that New Democracy used the data for statistical reasons but did not leak it.

It is worth noting that the minority expressed the opinion that they should all be discharged because of doubt, as they judged that it did not clearly arise from whom the violation was committed.
