Supreme Court rejects PTI’s larger bench plea – Pakistan

The Supreme Court has upheld the decision of January 13, dismissing PTI’s intra-party election review appeal.

The hearing on the review petition against the PTI intra-party election decision has started in the Supreme Court. A three-member special bench headed by the Chief Justice conducted the hearing. The bench included Justice Muhammad Ali Mazhar and Justice Musrat Hilali. PTI had requested to constitute a larger bench in the revision petition.

Tehreek-e-Insaf’s lawyer Hamid Khan came to the rostrum and said that the matter for forming a large bench should be sent to the Judges Committee, this matter should be sent to the Judges Committee and a new bench should be formed.

He said that the present three-member bench cannot hear the case, a 13-member bench has already given its verdict in the Sunni Ittihad Council case.

Chief Justice Qazi Faiz Isa remarked that this is a matter of revision, we have to look at the law, in the revision petition, questions have to be raised on the legality of the judicial decisions. The Chief Justice inquired why you did not raise this point earlier.

Hamid Khan said that the court should look at the paragraph of the decision of Sunni Ittehad Council and Election Commission case. The Chief Justice remarked that why should we see that decision, this is another matter, that is a separate matter.

Chief Justice Qazi Faiz remarked that you want to run the case or not? Hamid Khan said that now I say what I did not want to say.

The Chief Justice said that I like people who talk face to face instead of talking on TV. Hamid Khan said that I cannot give arguments in front of a person who is very biased against us.

Chief Justice Qazi Faiz Isa remarked that I cannot force you. Lawyer Hamid Khan said that I should not give arguments.

Justice Musarat Hilali remarked that when Mr. Niazi was the Prime Minister, the notice of inter-party elections was given, even then it was not conducted, is it not that you people are not interested in inter-party elections?

Later, the Supreme Court dismissed the revision petition of Tehreek-e-Insaf.
