It is she who has established that the transfers of migrants to Albania should not be carried out. The reason: the two countries of origin of the migrants (Bangladesh and Egypt) are not safe and must return free to Italy. After the judge’s decision, which did not validate the provision, the 12 foreign citizens will return from Albania tomorrow and disembark at the port of Bari. The provision, which ordered their placement in the detention centre, awaiting repatriation, had been ordered by the police headquarters between 16 and 17 October and the group, some of whom were asylum seekers, had been transported to the CPR by the Libra ship of the Italian Navy. The detention of migrants arriving at the Gjader CPR in Albania “were not validated in application of the principles, binding for national judges and for the Administration itself, enunciated by the recent ruling of the CJEU of 4 October 2024 following the preliminary ruling proposed by the judge of the Republic” – writes the president of the Immigration Section of the Court of Rome. The magistrate then adds, in the six pages with which he ‘freed’ the 12 foreigners: “The refusal to validate detention in Albanian structures and areas equated to Italian border or transit areas is due to the impossibility of recognizing them as ‘countries the States of origin of the detained persons are safe, with the consequence of the inapplicability of the border procedure and, as foreseen by the Protocol, of the transfer outside the Albanian territory of the migrant persons, who therefore have the right to be taken to Italy”.

Well, Sangiovanni is the same magistrate who last September 25th rejected the decision of the Privacy Guarantor, who had stopped the broadcasting by a Rai program of some sensitive documents on Armando Siri, former parliamentarian and undersecretary of the League . A provision that has become relevant again in the hours in which the controversy over the short circuit between politics and justice is raging.
