They arrive in Bari in the early afternoon, aboard the Coast Guard patrol boat ‘Visalli’ which left the Albanian coast in the morning. The 12 migrants (7 Bangladeshis and 5 Egyptians) coming from the Gjader reception center are already in Italy (transferred to the reception center for asylum seekers in the Apulian capital), following the ruling of the Court of Rome which yesterday did not validate their detention in the brand new structure created based on the agreement between Rome and Tirana. A decision that raises tension between the opposition and the majority. As announced immediately by the Prime Minister, the executive is currently studying a provision that will allow migrants to continue to be transferred to the centers set up in Albania: the most accredited hypothesis, on which the Council of Ministers convened on Monday at 18 at Palazzo Chigi, is that of a law decree, immediately effective, which would therefore elevate the list of countries considered safe for the repatriation of migrants to the rank of primary law.
The government initiative, moreover, is confirmed with a hard face by the Minister of Justice Carlo Nordio: while specifying that the attack is not “against the judiciary but against the merit of this sentence”, the Keeper of the Seals speaks of a decision “that does not only we don’t agree but we even consider it abnormal”, and therefore – announces “we will intervene with legislative measures”. In fact “it cannot be the judiciary that defines a more or less safe state”, explains Nordio, who believes “it is almost sacrilegious to think that the government to which I belong declares war on the judiciary, which is not and never will be. However, if judiciary exceeds its powers as in this case, attributing to itself prerogatives that it cannot have, such as that of defining a safe state, then politics must intervene, because politics expresses the popular will”. The deputy prime minister and leader of the League Matteo Salvini is no exception, for whom “whoever prevents us from defending the borders puts the country in danger”. For this reason, it convenes “with utmost urgency” a federal Council of the League after “the attack on Italy and Italians launched by a politicized part of the judiciary”, reports the Carroccio, announcing motions in the Italian municipalities in the next few days to reiterate the need to defend the borders, and making an appointment for Saturday 14th and Sunday 15th December for gazebos in all cities in view of the Open Arms ruling expected on 20th December.
Declarations which, according to the secretary of the Democratic Party Elly Schlein, constitute “a very serious institutional clash fueled by the government to cover up their inability. It is not the fault of the judges and it is not the fault of the opposition if they do not know how to read the laws and sentences. Nobody is above European, international and Italian laws. Nor are those who govern”, attacks the dem leader, who warns: “To circumvent the sentences of the European Court of Justice they should leave the European Union if it wasn’t the first time.” From the Nazarene therefore comes the request for Nordio’s resignation, because “in a democratic country, whose democratic and civil life is regulated by a Constitution – in which the principle of separation of powers is clearly engraved – a Minister of Justice who launches an attack so heavy on the Judiciary and its independence it cannot remain in its place”. And even those who “due to personal history and political conviction” are “the last to want to defend the judiciary”, such as the leader of Italia viva Matteo Renzi, underline that “Giorgia Meloni has made a sensational mistake: she is wasting hundreds of millions of Italians only because of her personal whim. She is an influencer, not a statesman.
