BNP Paribas Fortis was not authorized to charge fees to a former client when he transferred his securities account (shares, bonds, etc.) to another bank, according to a ruling by the Antwerp Court of Appeal .
After the termination of the banking relationship between the two parties, the bank claimed total compensation of 2,100 euros, we read in the judgment. The former client had turned to justice a few years ago.
“A normally informed, reasonably prudent and attentive consumer cannot be expected to establish the link between the bank’s general conditions, the investment services and the price list“, the judgment further indicates. The court of appeal ordered the bank to reimburse the fees that had initially been charged. All legal costs are also the responsibility of BNP Paribas.
