In the Supreme Court of Lithuania – the case of Anykščiai mayor K. Tubi’s influence on trade

This case was assigned to be examined out of sequence: the ruling on the appointment of a more urgent hearing stated that trading in influence is a crime of a corrupt nature, the mayor is a directly elected head of the municipality, so it is important to ensure the trust of citizens.

The prosecutor aims for K. Tubiis to be given two criminal sanctions for four years: the deprivation of the right to work in the public service, to hold the position of council member or mayor, and the deprivation of public rights to be elected as a member of the municipal council or mayor.

The politician also appealed the decision of the Panevėžys District Court, which found him guilty of one episode of influence peddling, announced in February.

In February 2022, the Molėtai Chamber of the Utena District Court acquitted K. Tubis, and on February 2 of this year, the Panevėžys District Court found him guilty of demanding financial support for his public election committee in preparation for the 2019 municipal mayoral and council elections.

It was established that at the end of 2018, K. Tubis promised a businessman from Anykščiai to influence the municipal employees so that they would urgently allow the company he represented to rent a plot of land and obtain permits to carry out construction of the height desired by the businessman. For this, the company’s representative found a person on whose behalf 1,000 was transferred to the account of the election committee headed by K. Tubis as a donation. euros.

The Panevėžys district court awarded the politician 9.9 thousand. a fine of EUR 1,000 and a measure of punitive effect confiscation of euros as a result of his criminal act, he was also deprived of the right to work in the civil service for four years.

Due to two more episodes of influence peddling, K. Tubiis was acquitted.

The indictment has caused uncertainty as to whether the politician who was re-elected mayor of Anykščiai district in March of this year can hold office.

In July, the Court of Appeals announced that all uncertainties regarding the ban on K. Tubi’s office can be removed only by the Supreme Court hearing the criminal case.
