The court rejects demands for a temporary stop on three oil and gas fields

– The Court of Appeal’s conclusion is that barriers that apply to the courts’ right of review and democratic considerations indicate that an injunction cannot be decided, says the ruling that came on Monday afternoon.

A temporary injunction would in effect shut down all operations at the three petroleum fields covered by the climate lawsuit – Breidablikk, Tyrving and Yggdrasil in the North Sea.

Concrete decisions to deal with the climate crisis, such as a possible shutdown of petroleum operations, must primarily be made by the Storting and the government, according to the Borgarting Court of Appeal’s summary of the ruling.

The ruling will be appealed, Greenpeace announced shortly after it was handed down.

In January, Greenpeace and Natur og Ungdom won on all points in the lawsuit against the state regarding permits for the development of the three oil fields. The Oslo District Court ruled that all three permits are invalid.

The Court of Appeal will later hear the state’s appeal against the district court’s judgment. The ruling on Monday only concerned the question of whether production and development at the fields should be halted pending a legal clarification.

This treatment is currently postponed pending an advisory opinion from the EFTA Court on the interpretation of the EU project directive.
