Prosecutor Moves to Drop Maming’s PK Citing Non-Binding MAKI Test Results

THE COUNCIL OF Supreme Court (MA) Judges was asked to reject the judicial review (PK) proposed by mining business permit (IUP) corruption convict Mardani H Maming. The reason is, there is no strong reason for the judge to accept this legal remedy.

“My version is super clear, there is no reason to accept PK Mardani H Maming. “The examination is not binding, it is limited to a love letter, it can be accepted or rejected, and independent judges cannot be influenced by anyone,” said Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman, Jakarta, Monday (7/10).

Boyamin conveyed this in response to the steps taken by legal experts who carried out an examination of the Mardani Maming corruption case. Legal experts put this examination into a book related to the Mardani Maming case.

Boyamin views the examination carried out by legal experts as mere dynamics. The reason, said Boyamin, was that the examination carried out by legal experts had similar content to the mitigating witnesses in the trial of the convict in the corruption case that ensnared Mardani Maming.

“I see the examination as a mere legal dynamic. “Because on the other hand, Mardani Maming at the trial presented a mitigating expert witness whose content was similar to the examination, in fact the judge rejected it and Mardani Maming was found guilty of corruption,” he stressed.

Boyamin reminded the judge’s decision at the Banjarmasin Corruption Court, appeal and cassation, that Mardani Maming had been proven guilty of committing a criminal act of corruption. He asked all parties carrying out the examination to respect this decision.

“In fact, the judges at the District Court, appeal and cassation level have already decided that they are guilty, so we respect all of that,” said Boyamin.

The court of first instance has found Mardani Maming guilty. He was sentenced to 10 years in prison and a fine of IDR 500 million.

The former chairman of the Indonesian Young Entrepreneurs Association (HIPMI) was proven to have received bribes for the issuance of a Decree on the Transfer of IUP OP from PT BKPL to PT PCN. This was done when Mardani H Maming was the Regent of Tanah Bumbu.

The panel of judges chaired by Hero Kuntjoro imposed an additional penalty of paying state compensation amounting to IDR 110.6 billion with the stipulation that, if they do not pay, their assets will be confiscated and auctioned off, or replaced with 2 years in prison.

Dissatisfied with the decision of the Banjarmasin Corruption Court, Mardani Maming submitted an appeal to the Banjarmasin High Court (PT). The panel of judges led by Gusrizal increased Mardani’s prison sentence to 12 years.

Then, Mardani Maming filed an appeal to the Supreme Court. Supreme Court Justice Suhadi accompanied by Supreme Court Justice Agustinus Purnomo Hadi and Supreme Court Justice Suharto rejected the appeal.

The Supreme Court Panel of Judges also sentenced Mardani Maming to pay compensation of Rp. 110.6 billion, subsidiary to four years in prison. Mardani Maming’s name emerged again after he was caught registering a PK on June 6 2024. The PK submitted by Mardani H Maming was number 784/PAN.PN/W15-U1/HK2.2/IV/2024. (Medcom.id/Nov)
