Dariusz Barski was not allowed to enter the headquarters of the National Prosecutor’s Office

Let us recall that in January, Prosecutor Dariusz Barski received a letter from Prosecutor General Adam Bodnar, which stated that he was not a national prosecutor. This decision was justified by the incorrect – according to Bodnar – reinstatement of Barski to the prosecutor’s service by Zbigniew Ziobro on February 16, 2022, because it was based on the transitional provisions of the Law on the Public Prosecutor’s Office, which were no longer in force at that time. By the Prime Minister’s decision, Jacek Bilewicz took over Barski’s position for a short time. Currently, this function is held by Dariusz Korneluk. This decision is questioned by part of the legal community, which still recognizes Barski as the head of the National Prosecutor’s Office.

Last Friday, the Supreme Court found that the reinstatement of prosecutor Dariusz Barski and his appointment as national prosecutor in 2022 had a binding legal basis and were effective. A statement on this matter was published by the National Prosecutor’s Office. It was stated that “the position in the case with reference number I KZP 3/24 is not a resolution of the Supreme Court within the meaning of Article 441 of the Code of Criminal Procedure. This position has no legal effects because it was taken by unauthorized persons.”

Dariusz Barski: there is only one national prosecutor

On Monday morning, Dariusz Barski appeared in front of the headquarters of the National Prosecutor’s Office at ul. Progress in Warsaw. He told the gathered journalists: “There is only one national prosecutor. I perform this function in accordance with the judgment of the Supreme Court.” According to RMF FM radio, he was not allowed to enter the PK building.

Previously, politicians of Sovereign Poland, including: Patryk Jaki, Jacek Ozdoba and Sebastian Kaleta announced during a press conference that, in connection with the Supreme Court’s judgment, they would submit a request to the police to “remove the Bodnarists from the National Prosecutor’s Office.”
