The former minister of the SYRIZA government testified that on the fateful day he was at the Unified Operations Coordination Center of the Fire Brigade and repeated that all he told the leadership of the House was to set priorities. When asked by the president of the court if it was his order to divert a helicopter to the Corinth refineries, he said that not only did he not give such an order but he was not even aware of it.
“From the first moment that the fire occurred, before Mati, I had told the leadership of the fire department to set priorities. The political leadership does not determine the details, but rather how the war will be fought in general terms. At ESKE I was at all critical fires and events, to have an overview of the situation. That’s how I’ve learned to be on the front line, that doesn’t mean I interfered with their duties. I said that the aerials should only go to Kinetta and Mati”.
The specific phrase about the priorities and mission of the aerial forces in Kinetta and Mati caused a barrage of questions from the district attorney.
-Prosecutor: Wasn’t this (about priorities and aerials) an indirect order? What does priority mean?
-Witness: No, I didn’t say that. The worst thing is to scatter the media…
– Prosecutor: I understood that the order you gave them is that we sacrifice something and gain something. What did you tell them, let Mati burn and Kinetta be saved or vice versa? Is this an operational order?
-Witness: It was war that day. We had 14 fires! I told them to prioritize and people prioritized.
-Prosecutor: If you give them an order to set priorities, is it an operational order?
-Witness : Look how much confusion there can be here.. I didn’t cause confusion I just tried to help the situation.
At another point, the witness was asked by the prosecutor whether he has reflected on what caused confusion in the operational staff.
-Prosecutor: Have you thought about the great confusion you caused to the staff?
– Chairman: The witness said that he had no operational authority.
-Witness: I am not accused.
-Prosecutor: You are not a defendant, you are a witness and if you have given orders this may lighten the responsibilities of some. It does not exempt them, but it lightens their position.
In a dialogue he had with a member of the court, regarding the responsibilities that may have existed, Mr. Toskas was clear:
– Conference: You were asked if after so many years there are responsibilities in the fire department. And you answered that you don’t see big responsibilities. What did you mean by what you said?
-Witness: We had a tragedy. Innocent people should not be blamed. If we look for details we will surely find mistakes. It was inevitable as a fact.

To the remark that the former commander of ESKE, Ioannis Fostieris, had testified that the former minister was giving orders and if he did not obey them, he was in danger of being expelled, Mr. Toskas replied:
“None of their actions were influenced by any instruction, direction or command of mine. It follows that I did not give any order.”
Also, the witness said that there was never a question of informing the citizens in Mati, because the person in charge of the field never gave such information as, as he mentioned, even if they suggested something like this, it could not be done. He even added that during that period “we put the water in the gutter” for 112, which however was not working at the time.
