THE MINISTRY of Law and Human Rights (Kemenkum and HAM) stated that many political parties are in suspended animation based on the performance of party organs as internal legal entities of political parties.
Director of State Administration of the Directorate General of General Legal Administration (Ditjen AHU) of the Ministry of Law and Human Rights, Baroto, said that the suspended political party almost never held national deliberations (munas) or working meetings (raker).
“The name of the party is still registered as a legal entity at the Ministry of Law and Human Rights, but since its inception it has only had one or two national meetings and for years it has not done anything,” said Baroto in a Public Lecture at the Faculty of Law, University of Indonesia (UI) which was monitored closely. online in Jakarta, Thursday (26/9).
Therefore, he said this must be questioned, especially regarding the purpose of the political party that was founded, which should aim to build democracy in Indonesia.
Not only related to organ performance, he said, political parties that want to advance Indonesian democracy must first pay attention to the internal legal bodies of other parties, such as the democratic distribution of authority, the cadre system, and strengthening the role of regional administrators.
Baroto revealed that in total there are 76 political parties with legal entities registered with the Ministry of Law and Human Rights, but only 44 political parties are active to date, including three new parties, namely the Gelora Party, the Ummat Party, and the Indonesia Bangkit Bersatu Party (IBU).
Meanwhile, he continued, there were only 18 political parties participating in the general election (election). Apart from that, it was recorded that 21 parties had changed their names and 14 political parties had acquired them.
He also said that if a political party remains a legal entity and is registered with the Ministry of Law and Human Rights, then its position is the same as others, including when filing a lawsuit at the Supreme Court (MA) or Constitutional Court (MK).
“That’s why usually lawsuits that go to the MK and Supreme Court are carried out by parties that are not too big,” he said. (Ant/J-2)
