Marquez asked the TSJ to declare Maduro’s victory null and void

  • The opponent explained that the document was received at the Supreme Court headquarters and he expects the file number to be assigned within three days.

Former presidential candidate Enrique Márquez on Wednesday, September 25, asked the Constitutional Chamber of the Supreme Court of Justice (TSJ) of Venezuela to declare null and void the ruling that validates the controversial reelection of Nicolás Maduro proclaimed by the National Electoral Council (CNE) in the elections of July 28.

“In this case (…) we come to the Constitutional Court to request the annulment of ruling number 31, issued by the Electoral Court, and that from there Venezuelans can find themselves on a path to rescue democracy, to rescue the value of the vote,” explained Márquez outside the TSJ, in Caracas, where he submitted his request.

The opposition leader said that the document submitted – supported by 28 people from different political sectors – was received by the Supreme Court, controlled by magistrates close to Chavez, and explained that in the next three days the case number must be assigned and, subsequently, within a period of five days, the magistrate must be appointed to handle the case.

“We have shown the flaws of unconstitutionality, above all, the violation of popular sovereignty reflected in the vote, of due process. This was a process of madness in the Electoral Chamber and we want the Constitutional Chamber to certify that, indeed, these flaws existed,” he added.

Resolving controversy over election results

The former candidate said that the country “needs an answer” and that he considers that the Constitutional Chamber of the Supreme Court is the last institutional reserve that he has to resolve the controversy surrounding the election results.

“So here we are, satisfied with the legal work, and now we move on to the political work, which is that we intend for this document to be the banner of a civic movement, in peace, for the Republic, for the Constitution,” he added.

On August 22, the Electoral Chamber of the TSJ, chaired by Caryslia Rodríguez, validated the official results of the July 28 elections, which gave victory to Maduro, questioned inside and outside the country.

Meanwhile, the majority opposition – grouped in the Democratic Unitary Platform (PUD) – maintains that its standard-bearer, Edmundo González, is the winner of the elections based on “83.5% of the electoral records” collected by witnesses and table members on election day, to reinforce its claim.

To date, the CNE has not published the disaggregated results – as established in its schedule – that confirm Maduro’s victory, despite numerous requests from the opposition and a large part of the international community.

Recusal against Caryslia Rodriguez

Enrique Márquez requested on August 20 a Recusal against the president of the Electoral Chamber of the TSJCaryslia Rodríguez, for pointing out that she has a political connection with Nicolás Maduro.

Márquez explained that she is also related to the United Socialist Party of Venezuela (PSUV) and claimed that at no time has she hidden her political partisanship. This could mean bias when working on the appeal filed by Maduro for the expert appraisal of the electoral results of July 28.

Following the Electoral Chamber’s call to presidential candidates for the July 28 elections to sign a document to endorse the results issued by the National Electoral Council (CNE) in August, Márquez refused to sign the document because he believes he was summoned and asked to sign a document without specifying the details of the same.

“The Electoral Chamber allows us to consider ourselves notified without knowing the appeal. I must inform that I refused to sign the notification act because I do not feel notified of anything. The notification must be accompanied by the reasons for the call,” said Márquez in his speech to the media.
