Practice and Procedure Amendment Ordinance Implementation Begins, Justice Munib Out of Committee – Pakistan

After the approval of the Supreme Court Amendment Ordinance by the Prime Minister and the Federal Cabinet, the President of the State signed the amendment ordinance under which the powers of the Chief Justice of Pakistan have been increased under the Ordinance. The implementation of the ordinance has also started and Chief Justice Qazi Faiz Isa has included Justice Aminuddin in place of Justice Mani Akhtar in the three-member committee formed to form the Supreme Court bench.

The Ministry of Law sent the ordinance to the Prime Minister and the Federal Cabinet yesterday, the Cabinet approved the Supreme Court Amendment Practice and Procedure Ordinance.

The federal cabinet approved the draft through summary circulation and the Practice and Procedure Amendment Ordinance 2024 was signed by the President.

The Ordinance will increase the authority of the Chief Justice in assigning cases to the Supreme Court. Under the Ordinance, the Chief Justice of Pakistan, senior judges and judges appointed by the Chief Justice will assign cases for hearing.

Declaring the Practice and Procedure Act 10-5 constitutional, the Supreme Court denied all petitions

“Practice and Procedure Decision will not apply everywhere, to be seen in the context of s. 191”

Earlier in the law, a 3-member bench of the Chief Justice and 2 senior-most judges appointed cases. Under the Ordinance, the bench will hear cases keeping in view public importance and fundamental human rights. Each case will be heard in its turn. The reason will be given on appointment.
