It is also noted that Colombian Aeronautical Regulations allow international aircraft to remain in Colombian territory for a period of up to 48 hours.

«In consideration of the international law that the YV 3226 aircraft is in such condition, and the information gathered about the operational incident, the takeoff of said aircraft is authorized to continue its flight to its final destination and appreciates the assistance treatment that civil aviation demands for cases of emergency or help, and should be allowed, as appropriate, to continue the flight, given that as an aeronautical authority it is considered that it has not entered Colombian territory without permission and that the incident corresponds to an aircraft that was in a dangerous situation.»

Likewise, these considerations apply to the crew, their passengers, their belongings, and their luggage, which for the purposes of Aerocivil are part of an incident beyond their control, the cause of which corresponds to an alleged navigation error.
