Federal judge blocks Biden’s plan to regularize millions of undocumented immigrants

This week, a court decision has captured the attention of migrants living in the United States. It turns out that a federal judge in Texas decided to block a program of President Joe Biden.

This project was intended to regularize the situation of almost half a million undocumented immigrants, spouses or stepchildren of American citizens.

The decision comes after 16 states, led by Republicans, sued the US government last Friday to stop the Keeping Families Together program.

This plan is based on the so-called “Parole in Place,” which grants a temporary permit to remain in the country. It offers full protection against deportation, as well as the possibility of obtaining a work permit.

The most outstanding thing is that it allows the beneficiaries complete the process to obtain permanent residence in the United States. The essential condition is to be married to or be the stepchild of an American citizen without having to leave the country.

Administrative suspension

The administrative suspension was issued by Judge J. Campbell Barker of the United States District Court for the Eastern District of Texas. Meanwhile, the complaint led by the attorney general of that state, Ken Paxton, is being considered.

According to the judge in question, the lawsuit was found to raise legitimate questions about the authority of the executive branch of government to bypass Congress and set immigration policies.

Therefore, after this suspension The administration will continue to accept applications, but will no longer be able to process them. Paxton himself said the rule violates the Constitution, the Administrative Procedure Act and immigration laws.

To join the program, the applicant must have lived in the country for at least a decade, and be married before June 17. The Biden administration estimated that about 500,000 spouses of American citizens and about 50,000 stepchildren are eligible.
