GUADALAJARA (EFE).— The 36 bar associations in Jalisco yesterday spoke out against the judicial reform that Congress will discuss because it would “harm” democracy and “subjugate” the judiciary, which is a counterweight to the government.
“It is unworthy that a Legislative Branch, an Executive Branch want to subjugate, humiliate and bend the Judicial Branch of the Federation, which is the counterweight to democracy,” said José Luis Tello, president of the Council of Bar Associations in Jalisco, which brings together 1,700 professionals, in a press conference.
He pointed out that with the approval of the President’s initiative, which seeks to establish the popular election of the Judiciary, the Executive intends to have “judges, ministers and magistrates to suit” his personal interests, for which reason he asked the full Legislature “not to be fooled.”
The judicial reform promoted by the ruling party, which will be discussed in Congress starting on Monday, provides for the total renewal of the Supreme Court ministers and half of the judges throughout the country by popular vote starting in 2025.
Pressure actions
Tello said that the popular election of judges and magistrates will cost around 64 billion pesos, which could be allocated to education or health.
He said that the indefinite strike that judges and magistrates will carry out starting today, Wednesday, is one of the actions to put pressure on this initiative.
“This is a clear example (of the actions), as long as the Executive does not reason and has its feet firmly planted to reverse this reform to the Judicial Branch, because it is erroneous and because it interrupts and violates individual guarantees and above all the rule of law,” he said.
The lawyers said that any professional who wants to be in the judiciary must have special training that not everyone can have, since it requires knowledge of legal and legislative issues.
The president of the College of Lawyers in Oral Trials, Agustín Flores, said that the reform seeks to create a Disciplinary Court to punish bad officials, an unnecessary measure because control bodies already exist.
“There are always controls, the Federal Judicial Council has its disciplinary committee and they have a legal figure, which is the administrative complaint, any person who notices that an official is not performing his function can report this inappropriate behavior,” he explained.
