Books- Ahmed Jumaa and Ahmed Abu Al-Naga:

Zamalek player Ahmed Fattouh carried out an attack after a “police secretary” was hit by a car and killed by Zamalek player Ahmed Fattouh The test results raised questions about whether it was evidence of guilt.

Test results conducted at El Alamein Model Hospital showed that Fatouh tested positive for cannabis use and negative for other narcotic drugs such as tramadol.

Zamalek goalkeeper Mohamed Sobhi was in the car with Fatu as he returned from the north coast before knocking over the victim, who was working as a police secretary. Detained at a North Coast police station.

A medical source familiar with what happened inside the Alamein hospital told Masrawi, “A urinalysis performed by Fatou showed that he had only used cannabis and was negative for other narcotic drugs such as tramadol.”

“The analysis is done via a rapid tester (quick test) rather than a digital blood analysis,” the source added, explaining that the analysis could serve as “a preliminary indicator of a player’s drug use, similar to what happens during traffic events.” situation.

Masrawi spoke with four medical professionals who specialize in toxicology and addiction testing, as well as a lawyer, to explain the results of the analysis and what to expect as judicial authorities continue their investigation.

A source who declined to be named said, “This analysis shows that he used some form of marijuana, which means he smoked hashish, banjo or marijuana, or sat next to someone using these substances, But used it for a long time.

He explained that “most likely he had smoked a form of cannabis and that’s what showed up on the drug test strip”, but then another procedure was carried out where a blood sample was last obtained for new analysis of usage and Its percentage in the blood.

On whether this was conclusive evidence of abuse, another source who previously headed the Addiction and Abuse Control Unit said, “The rapid test is not evidence of abuse, but it has to be measured using the new confirmatory test. Percentage in the body.”

He pointed out that the usual procedure in such cases is for the hospital to retain the same sample and send it for confirmatory analysis, stressing that “this rapid test cannot be relied upon for any decision or action except after the confirmed results are available” .

He gave an example: “If an employee takes drugs in the company and management decides to fire him based on this rapid test, he can easily appeal and get back to work.”

A third source at the Ministry of Health’s Addiction Treatment Laboratory and Analytical Division agreed with the recommendation, stressing that “preliminary analysis is not conclusive evidence and the matter requires confirmatory testing.”

What does the law say?

Lawyer Ayman Mahfouz, who quashed the conviction, said a positive sample was strong evidence to convict anyone charged with drug offences, and was an aggravating factor for other crimes such as murder and negligent wounding.

But he emphasized that “if the arrest and search procedures are invalid, or the defendant is not in an active criminal state, the positivity of the sample itself is not a reason or some evidence that leads to the defendant’s conviction, and therefore, the positivity rate of the sample will not be considered.”

“Mahfouz” explained to Masrawy that, as for the player Ahmed Fattouh, “the arrest and analysis were carried out legally”. He pointed out that Article 34 of the Criminal Procedure Code allows judicial officers to order the arrest of a defendant who is present when there is sufficient evidence in the case of an active crime involving a felony or misdemeanor punishable by more than three months’ imprisonment. He, considering that “at the scene of Fatouh’s crime, if arrest and search were allowed, a medical examination would be one of the types of searches.”
