Fabiola Yañez resumes complaint for gender violence against Alberto Fernández

The former Argentine first lady Fabiola Yañez made the decision to denounce the alleged physical and psychological abuse she received from former president Alberto Fernández, who was her partner between 2019 and 2022.

Despite a first refusal to carry out a legal process against Fernández a few weeks ago, Yañez asked Judge Julián Ercolini, a lawyer who is also pursuing a case against the former president for alleged irregularities in the contracting of State insurance, to initiate the investigation regarding the mistreatment she received at the Quinta de Olivas (presidential residence) by her ex-husband.

In that sense, the judge issued “restriction measures” against the former president, which includes the impossibility of leaving the country, as well as a restriction order, because, Yañez said in her complaint, Alberto Fernández harasses her “on a daily basis.” ” by phone.

Evidence of the assault

In Ercolini’s investigations into alleged irregularities in insurance contracts with Argentine State funds during the Fernández presidency, an expert opinion was carried out on the telephone of María Cantero, secretary of the former head of state, where conversations between Yañez and Cantero regarding the episodes of violence of which the first was a victim at the hands of the former president.

Given this information, the judge opened a reserved file in the file of the first case and, on June 26, sent it to the Gender Violence Office of the Supreme Court of Justice of the Nation. From there, they sent it to the Judge again and Ercolini decided to call Yañez and ask if she was willing to file a criminal complaint, which she refused.

However, Yañez’s telematic statement was recorded, which lasted more than an hour and a half, although the file was archived at that time. After almost five weeks, the former first lady changed her mind and decided to file the complaint.

Fernández assures that “everything is false”

Criminal lawyer Juan Pablo Fioribello, who represents the former first lady, stated in television statements that Fernández told him that “he had never hit a woman in his life,” denying acts of gender violence against the mother of his son.

While the same former president published a statement on his social networks in which he assured that the truth of the facts “is different.” “I’m just going to say that it is false and that what I am now accused of never happened,” he stated, quoted by page 12.

He suffered physical blows

At the time Yañez filed the complaint, he confirmed that she suffered physical blows, and Fioribello himself explained that he noticed her “very distressed.” “I can’t stand this situation anymore, he told me, and he also told me verbatim ‘I just reported him for the beatings and threats I received, I can’t continue like this,'” the lawyer said.

“She never told me that he hit her. Today she told me that she had suffered physical blows from the former president and that she was very distressed. That is why she contacted the court,” she reiterated.
