If relief is to be given to PTI, Article 51, 63 and 106 must be suspended, dissenting note issued by two judges on the decision of specific seats – Pakistan

Justice Aminuddin and Justice Naeem Akhtar Afghan of the Supreme Court have issued a detailed dissenting note regarding the decision to give reserved seats to PTI.

Justice Aminuddin Khan and Justice Naeem Afghan dissented from the majority judgment of the bench, the dissenting judgment of both the judges consists of 29 pages.

The dissenting note states that the Sunni Ittehad Council did not participate in the general elections as a political party, the chairman of the Sunni Ittehad Council also contested the election as an independent.

The two judges raised questions on the majority decision not yet being issued in the dissenting note and wrote that despite the expiry of the 15-day period, the majority decision could not be issued.

The dissenting note said that since PTI was not a party in the case, relief to PTI would have to go beyond the jurisdiction conferred in Articles 175 and 185, Articles 51, 63 and 106 to grant relief to PTI. Must be suspended.
