The Election Commission has challenged the Peshawar High Court’s decision to return the election symbol of the bat to the Pakistan Tehreek-e-Insaf (PTI) in the Supreme Court.
The Election Commission filed an appeal in the Supreme Court against the decision of the Peshawar High Court. The Supreme Court also allotted a diary number to the appeal of the Election Commission. In the appeal, the stand was adopted that the decision of the Peshawar High Court is against the constitution and the law.
It may be remembered that yesterday Peshawar High Court suspended the Election Commission’s decision in the election symbol case and allowed Pakistan Tehreek-e-Insaf (PTI) to contest the election on the ‘bat’ symbol.
Peshawar High Court Justice Ijaz Anwar and Justice Arshad Ali heard the PTI intra-party election and election symbol case.
It should be noted that in the hearing held on January 9, the lawyers of PTI and Election Commission had completed their arguments.
It should be remembered that on December 22, the Election Commission had declared PTI’s intra-party elections null and void and withdrawn the electoral symbol.
On December 26, the Peshawar High Court suspended the Election Commission’s decision to withdraw the ‘bat’ symbol from the PTI.
Later, on December 30, the Election Commission filed a review petition against the Peshawar High Court’s injunction regarding PTI’s election symbol.
The Election Commission of Pakistan had objected to the Peshawar High Court issuing an injunction without hearing the arguments.
On January 2, the Peshawar High Court had appointed PTI to hear the Election Commission’s petition against the restoration of the election symbol of the bat.
On January 3, the Peshawar High Court had withdrawn its injunction on the Election Commission’s petition against the restoration of the ‘bat’ election symbol, after which the PTI and Barrister Gauhar had withdrawn their injunction. Khan lost the party chairmanship.
