Khalid Sheikh Mohammed, the mastermind behind the September 11, 2001 attacks on the United States, has agreed to plead guilty, the U.S. Defense Department said Wednesday, but Pentagon officials did not make the full terms of the deal public.
According to the British news agency Reuters, a US official said on condition of anonymity that the agreement includes that the death penalty will not be given to the criminals in exchange for their pleas.
Wednesday’s plea deals with Khaled Sheikh Mohammed and two of his alleged accomplices appeared to resolve their long-running cases, but angered some relatives of those killed in the Sept. 11, 2001, attacks. The tide went out.
According to the French news agency AFP, Lloyd Austin said in a memorandum to Susan Scalier, who is overseeing the trial: ‘I have decided that the decision to enter into a pre-trial agreement with this accused is important. In hindsight, the responsibility for such a decision should rest with me.’
“I withdraw from the three agreements signed by you in the said case on July 31, 2024,” the memo said.

The cases against the 9/11 suspects have been mired in pre-trial legal wrangling for years while the suspects are held at the Guantanamo Bay military base in Cuba.
The New York Times reported this week that Khalid Sheikh Mohammed, Waleed bin Attash and Mustafa Al-Husawi had agreed to plead guilty to conspiracy in exchange for life sentences rather than face trial.
Much of the legal debate surrounding the cases of these men has centered on whether they could have been given a fair trial after 9/11, when they suffered systematic torture at the hands of the CIA. .
American authorities arrested Khalid Sheikh Mohammad in March 2003 in Rawalpindi, Pakistan. Khalid Sheikh Mohammed was subjected to 183 waterboarding and other forms of torture and forced interrogation while in CIA custody prior to his arrival at Guantanamo Bay.
The use of torture has been a major obstacle to US efforts to prosecute those held at the military commission at Guantanamo Bay, largely due to the inadmissibility of evidence of abuse.
