Retired workers: What they will pay and how to EFKA – Examples of deductions

EFKA with a new circular clarifies the landscape regarding the terms applicable from 1 January for both “old” pensionersbut also for those who retired at the end or beginning of 2024.

Retired workers they will be asked to declare to special platform that will open their personal information, their AMKA and VAT number, so that EFKA can then cross-check with the tax office and the Ergani system to verify the type of employment (salaried work, self-employment, self-employment), the amount of the fee and the tax that should be collected in favor of EFKA.

The new regime effective from January 1, 2024, is considerably more favorable than the existing one and combined with the fines provided for, it is estimated that the declared retired workers will increase from approximately 35,000 who are currently declared, to over 100,000.

In each case the goal is to increase EFKA’s revenuesthrough the special resource that is being established, considering that the estimates will be confirmed for a tripling of pensioners who will declare that they are working.

It is recalled that with Law 5078/2023 the 30% pension reduction which was imposed on working pensioners and from 1 January 2024 the reservation in favor of EFKA with 10%.

Deductions corresponding to employment for January will be collected in one installment, after the declaration of pensioners.

Pensioners employed as employees will have a 10% withholding in their wages, if they are self-employed with primary and secondary insurance, they will pay their monthly contributions to EFKA (for primary and secondary) with a 40% increase and if their employment is in a self-employed profession they will pay the main insurance contribution with a 50% surcharge.

Examples

In order to clarify the new framework of deductions for working pensioners, EFKA issued a circular with detailed examples for pensioners’ obligations.

  • A pensioner, due to old age, before 31.12.2023, who collects his pension and does not fall under the exemptions from the obligation to pay the resource, undertakes on 15.01.2024 employment as an insured in the e-EFKA. He is obliged to pay, through his employer, from 15.01.2024 and for as long as he continues this employment, a contribution of 10% of his insurable earnings.
  • A pensioner, due to old age, before 31.12.2023, who does not collect his pension (suspension of its payment) and does not fall under the exemptions from the obligation to pay the resource, undertakes on 15.01.2024 employment as an insured in the e-EFKA . He is not obliged, due to the suspension of the payment of his pension, to pay, through his employer, from 15.01.2024 and for as long as he continues this employment, and there is a simultaneous suspension of the pension, a resource of 10% of his insurable earnings.
  • A pensioner, due to old age, before 31.12.2023, who collects his pension and falls under the exemptions from the obligation to pay the resource, undertakes on 15.01.2024 employment as an insured in e – E.F.K.A. He is not obliged, as long as he falls within the exceptions, to pay, through his employer, a 10% contribution on his insurable earnings.
  • An insured person of the institution, who meets the legal conditions for retirement, submitted on 10.01.2024 an application for the award of a pension, due to old age, without interrupting his insurable employment to e – E.F.K.A. In addition, it does not fall under the exemptions from the obligation to pay the resource. He is obliged, from 01.02.2024 (date of commencement of payment of the requested old-age pension) and as long as he is employed as an insurer at e-EFKA, to pay, through his employer, a contribution of 10% of the insurable earnings of. If his pension request is finally rejected, the total amount of the resource that was withheld from him and attributed to the e-E.F.K.A. will be returned to him as unduly paid.
  • An insured person of the organization, who meets the legal conditions for retirement, submitted on 10.01.2024 an application for the award of a pension, due to old age, having previously stopped his employment. On 01.02.2024, he takes on a new job as an insurer at e – E.F.K.A. In addition, it does not fall under the exemptions from the obligation to pay the resource. He is obliged, from 01.03.2024 (date of commencement of payment of the requested old-age pension) and for as long as he is employed as an insurer at e-EFKA, to pay, through his employer, a contribution of 10% of the insurable earnings of. If his pension request is finally rejected, the total amount of the resource withheld from him and attributed to e-EFKA. will be returned to him as unduly paid.
  • An insured person of the organization, who meets the conditions for retirement, submitted on 30.11.2023 an application for the award of a pension, due to old age, and took up, on 15.01.2024, employment as an insured person at e – E.F.K.A. In addition, it does not fall under the exemptions from the obligation to pay the resource. The specific person is entitled, from 01.12.2023, to collect the requested pension. Consequently, he is obliged from 15.01.2024 (date of commencement of his employment, while he was already entitled to receive an old-age pension) to pay, through his employer, a 10% contribution to the insured his earnings. If his pension request is finally rejected, the total amount of the resource, withheld from him and assigned to e-EFKA. will be returned to him as unduly paid.
