Recommendation for formation of larger bench on petition against allowing phone tapping of sensitive institutions – Pakistan

The single bench of the Lahore High Court sent the file to the Chief Justice of the Lahore High Court recommending the formation of a larger bench on the petition once morest the federal government’s permission to tap phones of sensitive institutions.

In the petition, it was argued that the government of Pakistan has given permission to the sensitive agency to tap the phone in a notification.

In the petition, it was requested that the court should declare the notification allowing the sensitive agency to tap phone as illegal and suspend the proceedings on the said notification till the final decision of the petition.

Justice Farooq Haider remarked on the file that important legal points have been raised in the petition, in which case a larger bench should be constituted to hear the case.

The citizen of Lahore filed the petition through the mediation of Advocate Nadeem Sarwar, in which the Prime Minister, Federal Government and Pakistan Telecommunication, among others, have been made parties.

It was argued in the petition that the Government of Pakistan in a notification has allowed the secret agency to tap people’s phones, the section of the PTA Act under which the notification has been issued is yet to be enacted, the Constitution of Pakistan. Provides citizens with privacy, freedom of expression.

The citizen said that even according to the Supreme Court of India, tapping people’s phones is a violation of the constitution, requested that the court declare the government’s notification to allow the secret agency to tap phones as illegal and until the final decision on the said application. Suspend the notification process.

The citizen said in the petition that the government should be directed to frame the rules under Section 56 of the PTA Act.
