Representative Rojo Pimentel (PT) proposes to reform Article 2 of the political constitution
Deputy leader Ana Karina Rojo Pimentel (PT) presented an initiative reforming the Magna Carta, with the aim that the practice of the usages and customs of indigenous peoples and communities must not in any case violate the constitutional and legal rights of girls, boys and youth.
The amendment to Section II of Section A of Article 2 of the Political Constitution also states that indigenous peoples and communities, in applying their own regulatory systems in the regulation and resolution of their internal conflicts, will respect the dignity of minors.
The document, which has been sent to the Constitutional Points Commission, indicates that the reform proposal will protect and safeguard the rights of girls, boys and youth once morest the usages and customs of indigenous peoples and communities, by ensuring respect and valuing traditions, and making it known that no behavior that is custom or tradition is superior to the rights laid down in the Magna Carta.
It states that child marriage and violations of the human rights of girls, boys and youth persist in some regions of our country, where attempts are made to legitimize these illegal marriage ceremonies using traditions and customs as a basis.
These local practices and traditions, the legislator continues, are rooted in Mexican society and have on several occasions prevailed over civil laws, since they put the authorities in a dilemma when giving a resolution that respects the usages and customs of the community.
A consequence of child marriage, the initiative shows, is that children lack the right to make decisions regarding their bodies, family planning or the use of contraception, the consequences of which will have consequences for health and well-being in the long term.
It emphasizes that the dominance of usage and customs over regulations persists due to little socio-economic development and a lack of education, as well as knowledge of current laws that exclude these environments.
It adds that the use of usages and customs cannot be higher than the human dignity of people and the consent of the one who, where appropriate, is forced or coerced into marriage, for the simple fact of being a minor, and belonging to indigenous peoples who support these the practices.
