“In the case under consideration, the producer (distributor) of public information, by publishing (…) a copy of the administrative offense protocol of the Chief Police Commissariat of Vilnius County, without depersonalizing personal data, i.e. disclosing the address of the applicant’s place of residence and date of birth, abused the freedom of expression and disrespected the applicant’s right to personal data protection,” the document seen by BNS states.
However, the comedian’s complaint was recognized as only partially justified – the document stated that if the member of the Seimas made public the name of O. Shurayev, such disclosure of data is proportionate from the point of view of the public’s right to know.
Last August, a public figure applied to the Service of the Ethics Inspector of Journalists, asking to evaluate A. Gedvilos’ post on his Facebook account regarding his visit to the Seimas in March 2023. Due to insulting members of parliament, O. Shurayev was later punished administratively for a minor violation of public order.
The comedian claimed in the complaint that A. Gedvila’s post incites hatred towards him and added that he did not give his consent to publish his personal data.
O. Shurayev claimed that he did not feel safe because his personal data, such as his contact address, was made public in the context of negative content, “with the possible aim of provoking physical confrontation with him by persons who have a negative attitude towards him”.
At that time, a member of the Seimas argued that the publication of information was in the interest of the public to learn more regarding the high-profile event. He also said that some of the data was made public by mistake and was later removed.
The decisions of the journalist ethics inspector can be appealed to the Administrative Court of Regions within 30 days from the date of their publication.
