Outraged by the obstruction and inadequacy of the municipal services (which twice sent the payment orders to the wrong service!), the co-owners appealed to the Ombudsman and finally found their right! After 19 years, they saw the compensation amount in their bank accounts.
The case begins around 2000, when the municipality of Alexandroupolis proceeded to expropriate a plot of land to make way for a road. In 2005, the Deed of Settlement of Sanctions and Apportionment of Compensations was issued, due to severance, which provided for the payment of a total amount of 80,000 euros to the five co-owners. But the years passed and the money did not enter the bank accounts, as a result of which one of the co-owners appealed to the Ombudsman.
Officials of the Ombudsman pointed out to the competent Directorates of Technical Services and Construction, as well as Financial Services, the current legislative framework regarding the municipality’s obligation to pay the corresponding amount. In particular, they emphasized that following the issuance of a decision to re-enforce the compulsory expropriation, the municipality had to either proceed with the timely deposit of the above amount of money to the Deposit and Loan Fund in favor of the beneficiaries, in accordance with the Compulsory Expropriation Code, or issue nominal money orders payment of the appropriate compensation.
During the handling of the case, the officers of the Independent Authority discovered the unbelievable: the municipality had already issued money orders twice, in December 2022 and May 2023, but the disbursement of the compensation was not possible, due to the transfer of the file to an unauthorized Directorate of the Deposit and Loan Fund as well as due to incompleteness of the file, since it did not include the required deposit slips!
After communication, consultation and exchange of views, the municipality of Alexandroupolis informed the Authority that it will finally deposit the amount of the compensation (!) by proceeding with the establishment of deposit letters and sending the original letters and the tables of deposit to the Deposit and Loan Fund, in order to become it is possible to return the compensation amounts to the beneficiaries.
After the intervention of the Ombudsman, the municipality of Alexandroupolis, finally deposited the money and forwarded a complete file to the competent Directorate of Special Deposits. After checking the completeness of the file by the latter, the information was forwarded to the Alexandroupoli Depository Office and the compensation process for the beneficiaries was completed!
