An age limit of 75 years was established by the Senate Constitution Commission for notaries, archivists and real estate conservators to hold such positions. This, within the framework of the particular study of the project that modifies the registry and notarial system in its organic and functional aspects.

As explained by the president of the aforementioned legislative body, Senator Alfonso De Urresti, the measure is in line with modernizing the notarial system in the country and establishing objective standards.

“It is a great advance, because a rule has been established by which all those notaries, conservators and archivists who are over 75 years of age cease to hold office,” said the legislator following adding that a transitional article is established. 9 months from the entry into force of the law.

This is a provision that states that assistants to the administration of justice appointed prior to May 30, 1995 will have a period of 9 months to leave their positions.

“A year or two years of transition had been requested once they turned 75, but a period of 9 months was established to make a delivery and an orderly transfer of the office.” Likewise, the Commission rejected the indications that had been presented to allow those who turned 75 years of age to continue holding office following completing medical examinations. The argument that the senators gave to reject such proposals is that it is preferable to establish in the law an objective criterion such as a person’s age.
