Understanding and Exercising Patients’ Rights in Healthcare: Insights from France Assos Santé Barometer 2024

Carried out on a sample of 1507 people aged over 15 representative of the population, this barometer from France assos santé draws up an inventory of the knowledge and exercise of patients’ rights, defined by the Kouchner law of 2002.

Respect for medical confidentiality, direct access to medical records, free choice of doctor or health establishment, right to refuse or interrupt treatment… These rights are “mostly known and well applied”, underlines France assos santé. The federation of user representatives, however, identifies weak points: more than 4 out of 10 people questioned are still unaware of their right to draw up advance directives; For 40% of those surveyed, the wishes expressed were fully taken into account, but 36% consider that this was not completely the case – 15% of them even answered “not at all”.

Furthermore, almost half of the people questioned do not know that they have the possibility of recourse to compensation in the event of a serious problem linked to care or that they have a right of modification and opposition on the use of their personal health data.

The results of this barometer also reveal the growing difficulties of the health system: if 80% of respondents declare that their right to access care is respected, 8% consider that this right is “poorly applied”. In addition, 39% of respondents said they had a negative experience obtaining an appointment and 44% have already faced a drug shortage, compared to 29% two years ago.

To navigate the health system, the general practitioner “remains, by far, the first point of reference” for the French. But it is increasingly competing: 80% of respondents identify it as such in 2024, compared to 84% in 2023, 88% in 2022 and 93% in 2017. Same trend for the specialist doctor, which increased from 44% to 27% over the years. Conversely, the internet (forums and reviews) and platforms for making appointments and teleconsultation are increasingly becoming a reference: this is the case for respectively 37% and 27% of respondents.
