Bawaslu Needs to Evaluate Handling of Election Crimes

The General Election Supervisory Agency (Bawaslu) stated that it would conduct an evaluation of the handling of criminal acts in the 2024 Election to find solutions to various obstacles from previous experience.

Bawaslu member Puadi said that his party needed to identify problems from various aspects and cases to prepare references in facing the 2024 Simultaneous Regional Elections even though they used different laws (UU).

“In handling the 2024 election, there are good stories, there are also bad stories. Experiences during handling the 2024 election need to be evaluated from various aspects and cases that are considered interesting,” said Puadi in Jakarta, Sunday (31/3).

This former member of the DKI Jakarta Province Bawaslu assesses the need for evaluation of the legislative aspect, namely the Election Law Number 7 of 2017, which has the character of a lex specialis with a relatively fast handling time for criminal acts.

He explained that Article 486 of Law 10/2017, which contains four paragraphs, explains that the existence of the Gakkumdu Center (Integrated Law Enforcement) from three institutions, namely Bawaslu, the police and the prosecutor’s office, from the central (national), provincial, to district/city levels, is certainly experiencing problems in the process of handling election crimes.

“The application of legal norms that have multiple interpretations, are not applicable, and there is a legal vacuum that makes the handling time for violations take a long time to note one aspect of the legislation,” he stressed.

“Then implementing regulations such as PKPU (KPU Regulations) and other statutory regulations. “Then from the technical aspect of Gakkumdu’s institutional readiness, it is related to whether the implementation of the handling process experiences problems.”

These things, said Puadi, are a note for Bawaslu to evaluate in the future, what are the obstacles, including from the budgeting aspect.

Puadi also said it was necessary to conduct evaluation discussions based on interesting cases when dealing with criminal acts in the 2024 election.

“Like (actually what) is meant by falsifying documents, involving village heads, campaigning outside the schedule. Also related to what is called money politics. There is also a recommendation from Bawaslu to hold a PSU due to Indonesian citizens voting more than once with criminal handling,” he said.

He felt the need to sharpen mutual understanding as well as create solidarity for the Gakkumdu Center.

“Hopefully it can be identified to prepare future steps that will become our reference in facing the 2024 Simultaneous Pilkada. I hope this activity can present a solution and create a solid Gakkumdu at the district/city level so that it works even better,” stressed Puadi. (Z -11)
