The indictment, submitted through attorney Jonathan Tal from the Tel Aviv District Attorney’s Office, indicates that in June the complainant spent time with his partner in the pool in the yard of his private house in Arsov, and the two had intimate relations. At that time, the accused AA walked near the house and, noticing the actions of the two, recorded them in a video, and sent it to a number of people, including the accused BB, who also distributed the video in a WhatsApp group with his friends. As part of the correspondence in the group, an idea came up to blackmail the complainant or send the video to one of his associates.

At the beginning of July, another person contacted the complainant and threatened him to distribute the video he had obtained, if he did not pay him a sum of money. Accused BB contacted the complainant’s associate, and falsely claimed to him that a person named Inbar Levy took the video and showed it to him. Following this, the associate called Inbar Levy’s phone, which was actually another phone number of the two defendants, and asked to negotiate with them In order for him to delete the video, and in response, BB asked the associate for NIS 13,000. When the associate refused to pay, the accused BB asked the associate to send him the complainant’s phone number, while threatening him, “Trust me, I will get the number of … This (complainant) and I will send him the video…”.
