FORMER Chief Justice of the Constitutional Court (MK) Anwar Usman will not be involved in the process of challenging the results of the presidential election. This is in accordance with the decision of the Honorary Council of the Constitutional Court (MKMK) which decided that Anwar Usman should not be involved in election dispute matters at the MK.
Anwar is not allowed to adjudicate election or presidential election disputes at the Constitutional Court. This is to avoid potential conflicts of interest.
“Anwar is not involved in PHPU. If the presidential election is in accordance with the MKMK’s decision, he cannot be involved in the decision. The MK must obey that decision,” said Constitutional Court Spokesperson Fajar Laksono at the Constitutional Court Building, Thursday (21/3).
“The MKMK’s decision is clear, it does not involve, adjudicate, disputes over the results of the presidential election. If you are (involved) in the legislative elections with a note, then open the MKMK’s decision once more. What is clear, the note is, as long as there is a conflict of interest, it is not allowed,” he added.
Apart from that, Fajar reminded parties involved in PHPU cases to comply with the established rules and ethics. He reminded that there should be no meetings between the parties involved in the case and the MK judges to maintain neutrality in deciding cases and avoid the practice of bribing MK judges.
“Oh, of course, it doesn’t have to be Eid. On a daily basis, judges are not allowed to meet people who are litigants and people who are litigants are not allowed to meet judges because there is a code of ethics. So it doesn’t have to be Eid. That’s the same every day, right,” explained Fajar.
“Yes, judges have a way. However, the principle is to avoid meeting people with legal issues,” he concluded. (Z-2)
