The plenary session of the Constitutional Court approved the withdrawal of the Federated Sports Electoral Tribunal (Tedefe) and lifted the sanction on the statutes of the Guatemalan Olympic Committee (COG).

One day following the International Olympic Committee (IOC) provisionally lifted the sanction on the Guatemalan Olympic Committee (COG) and allowed Guatemalan athletes to participate once more under the national flag and symbols in the Paris 2024 Olympic Games, the Constitutional Court took another step to make this decision permanent.

This Wednesday, March 20, the Magistrates of the CC Leyla Lemus, Dina Ochoa, Roberto Molina Barreto and the substitutes Claudia Paniagua and Rony López They learned in a session of the withdrawal of the unconstitutionality action presented in April 2023 by the Federated Sports Electoral Tribunal (Tedefe) where it demanded that the suspension of the COG statutes be lifted, which had been out of force since August 2022. .

The suspension of these statutes, approved in December 2021, was what led the IOC to leave Guatemala outside of all competition as of October 2022.

In the statement that the IOC published following announcing that it was provisionally lifting the sanction on Guatemalan Olympic sport, it was clear in saying that It reserved the right to take any further action, including reinstating the suspension if there was any “new improper interference with the governance of the National Committee.”.

However, in the session on March 20, the CC approved by majority to withdraw from the unconstitutionality action and ordered to restore the COG statutes endorsed by the IOC in 2021.

This decision is key for the IOC to consider making permanent its decision to lift the suspension of Olympic sport in Guatemala.

The plenary session of the CC was made up of Leyla Lemus, who cast a reasoned and dissenting vote on approving the withdrawal; In addition, Roberto Molina Barreto, Claudia Elizabeth Paniagua Pérez and Rony Eulalio López Contreras, who approved the action.

The main magistrates, Néster Mauricio Vásquez Pimentel, who recused himself from hearing the case, and Héctor Hugo Pérez Aguilera, due to temporary absence, were not present.
