Bursting into sobs, the 72-year-old accused and remanded in custody for the murder of his 69-year-old brother, Babis Anagnostopoulos, heard the unanimous acquittal decision of the Mixed Jury Court of Patraswho was found dead in their home, in Ephyra Ilia, in September 2022.

“On 11/03/2024, following a monumental speech by the prosecutor of First Instance Patras, Mr. Ioannis Paisiou, where with logical and thorough arguments he deconstructed the indictment in its entirety, the court unanimously acquitted my principal, concluding that the death of Charalambos Anagnostopoulos was not is due to a criminal act, but to his self-harm, due to the chronic serious psychiatric health problems he was dealing with” Amaliada’s lawyer, Dionysis Zisimopoulos, told “P”.
Mr. Zisimopoulos speaks of a “wrong approach to the facts during the preliminary investigation”, which “initially led the prosecuting and investigative authorities to consider the death of H. Anagnostopoulos as a criminal act, resulting in the unfair temporary detention of his brother and my agent”.
The alleged fratricide, with the agreement of the investigator and prosecutor Amaliadas, in July 2023 he was temporarily detained in Korydallos prisons, where he remained for 7 months, for a “crime” that was never committed.
The 72-year-old was the one who found his brother dead and informed the authorities. Despite the witness statements that the 69-year-old Babis Anagnostopoulos had been diagnosed with schizophrenia for a number of years – at least 30 years – with disability certificates from KEPA and was receiving medication, however, they were not taken into account by the police authorities, which as Mr. Zisimopoulos reveals , they never looked for the man’s medical file, as they had initially focused their investigations solely on the homicide version.
The lawyers of Dionysis Zisimopoulos and Theodoros Antonopoulos submitted to the Prosecuting Authorities a medical opinion of the orthopedic surgeon Konstantinou Tragoustis that the 69-year-old’s death was the result of self-inflicted injuries, which was argued by the coroner of the Nice Hospital, Konstantinos Andreou.
The “apocalyptic” expertise
In the multi-page medical opinion presented exclusively today by “P”compiled by the appointed technical advisor to the 72-year-old’s family, the orthopedic surgeon of Patras, Konstantinos Tragustis, states, among other things, “that this is a classic case of self-injury”, pointing out that the “complete absence of characteristic defense-fighting injuries, especially when the deceased presented such a chaotic difference in body volume and mass with the alleged perpetrator and the absence of damage to the rest of his body of a human body, the exclusive low energy of the blows, the absence of even one serious injury, all of them simple and superficial, exclude homicide. It is pointed out that the self-injury should be investigated and this because the 69-year-old “was in a phase of disorganization, confusion, disorientation, he probably wanted to punish himself, bumping and dragging his head on various surfaces, (wall, furniture, etc. .) continuously inflicting injuries of the same intensity and gravity, mainly on the scalp”. These are, as pointed out, much less painful self-inflicted points chosen by a patient who is in a state of amok.
“Justice restored injustice”
Dionysis Zisimopoulos, Amaliada’s lawyer, speaking to “Peloponnisos tis Mondaya”, said:
“Justice restored an injustice to my client and allowed him, following almost 18 months, to mourn his much-loved brother who for 23 consecutive years he had under his protection. The “apology” of the president and prosecutor
After the announcement of the unanimous acquittal decision for the 72-year-old, the “apology” of the President of the Court Evangelos Kostakiotis and the prosecutor Ioannis Paisios caused a sensation. The first one, addressing the man, said that that he should not have been in prison and that the case should not have gone to court, with the prosecutor adding that now “you are redeemed and you can now go home in peace and cry for your brother, which for 18 months the circumstances had not allowed you».
The psychiatrist’s false testimony
In his statement to the Police, the psychiatrist who attended 69-year-old Babis Anagnostopoulos, for unknown reasons, stated that he had examined him once in September 2022, a few days before he was found dead. However, as it emerged from the investigation carried out by the investigator Amaliados following the remand of his 72-year-old brother, the documents of the medication that the “victim” received for the last 25 years were drawn up by the doctor in question! This man was summoned to testify by the investigator, however he did not appear before him, and he did not appear during the recent hearing either, with the chairman of the court wondering “why would a psychiatrist lie so much to the Police?”.
The unclear forensics
For 10 months, as Mr. Zisimopoulos claims, the Police waited for the completion of the forensic report by the Forensic Service of Patras on the death of Babis Anagnostopoulos. The answer came on June 19, 2023, but in it there was no clear “answer” to the basic question of whether it was a criminal act. In the content of the report, according to Mr. Zisimopoulos, reference is made to the existence of the wounds on the 69-year-old’s head and that his death was not the result of the wounds characterized as “trivial” and “bodily injuries”, but in the second year due to bleeding. The medical examiner is called by the police officers of the Ilida Security Department, in order to clarify whether it is a case of homicide or self-inflicted injury, and in his written statement he is said to argue that “from all the findings and indications, the death of Anagnostopoulos lends itself to the version of homicide”.
The fatal night
The 72-year-old had under the exclusive protection and care of his 69-year-old brother for 23 years. They lived together and he had repeatedly refused his confinement in a psychiatric clinic despite the persuasions of his relatives and friends. On the night of the tragic event, according to testimonies and video footage, he was with friends in a restaurant and before leaving he ordered food to take to the 69-year-old. Upon entering the house, he saw his brother covered in blood and in a state of shock called his son and the authorities for help. “They placed him as having committed homicide for a period of 3 minutes, without anything preceding it and without a single spot of blood being found on the clothes he was wearing. It hurt him, but he didn’t get splattered, and even the walls were covered in blood» states Mr. Zisimopoulos in a telling manner.
