The Regulation with Specifics, as amended, is effective from March 14, 2024
We will remind that on February 9, 2024, the Government adopted a list of changes to Resolution 1178, which were to enter into force following 30 days.
Well, that day has come, that is, from March 14, 2024, the changes to Resolution 1178 are already in effect. Therefore, be careful when viewing the Resolution on the website, and pay attention to which edition you are viewing.

What has changed?
From now on, state customers carrying out public purchases with budget funds must take into account these changes when purchasing certain food products added to the list in ” Appendix 2” Resolutions obliging to carry out the purchase by means of a request for the price of proposals (ZCP). We remind you that purchases made using the electronic catalog are carried out in accordance with the Procedure for the formation and use of the electronic catalog, approved by the resolution of the Cabinet of Ministers of Ukraine dated September 14, 2020 No. 822taking into account the provisions defined by these features.
When exactly should ZCP be conducted according to this list of products
This purchase is carried out under the condition that the value of the purchase item will be UAH 100,000. and more.
If the purchase through Prozorro Market did not take place
In this case, the customer can purchase at open auctions without increasing the expected cost. Or, once once more, conduct a public procurement process, taking into account the specifics of public procurement during the period of martial law.
Other changes
The government also adopted changes in the eighth paragraph of subparagraph 1 of item 44, namely:
government prohibits the purchase of goods, works and services from individuals and legal entities from the Russian Federation, Belarus and Iran. Also in companies whose final beneficiaries or owners of more than 10% of shares are citizens of these countries.
However, you should also be aware of the exceptions to this clause, including:
1. citizens live on the territory of Ukraine on legal grounds;
2. assets of citizens from these countries in supplier companies transferred to ARMA;
3. goods from the Russian Federation and the Republic of Belarus are necessary for the repair and maintenance of goods purchased before October 19, 2022.
