High Court: Grounded suspicion of rape in the Hjallerup case

The Vestre Landsret has assessed on Wednesday that there are grounds to suspect that a now 18-year-old accused of murder raped the 13-year-old girl who was found dead on Monday evening in Hjallerup.

Thus, the high court expands the grounds for suspicion once morest the man, who is charged with both murder and rape.

When the 18-year-old was remanded in custody following a constitutional hearing in the Court in Hjørring, it happened only on a “specially reinforced suspicion of murder” – and therefore not for rape.

Vestre Landsret has also found that there is “particularly strong suspicion” of murder, but also has “justified suspicion” of rape, says prosecutor Mette Bendix.

No visitor control

The now 18-year-old was imprisoned on the stipulation that consideration for the general sense of justice in the population requires that imprisonment take place.

It was prosecutor Mette Bendix who appealed the district court’s order because the prosecution also wanted the remand to take place for the sake of the further investigation.

From a purely legal point of view, this means that the police can introduce letter and visitor checks while the 18-year-old is in custody.

But nothing will come of it.

Neither the Court in Hjørring nor the Vestre Landsret believe that the 18-year-old would be able to influence the investigation if he was at large.

Moved to detention center

However, this does not change the fact that the 18-year-old must be remanded in custody. Initially until April 9.

The first few days he was in a closed institution for young people, but today – Thursday – he has been moved to a detention centre, says Mette Bendix.

He has turned 18 and is therefore of legal age.
