The transaction is therefore carried out. The seller bought the vehicle three days before, took a margin of €1,500 and resold it without warranty but with the original certificate of conformity.

The buyer found that the Porsche was not working properly. The restoration and repair work cost him €160,000 (27 invoices submitted) and the car, dismantled, is in his garage. After taking several steps, he ended up obtaining the certificate of authenticity in 2019.

“My customer was fooled, especially since the invoice is marked ‘matching member’, which means that the chassis, engine and gearbox numbers are the original ones and that no modifications have been made. place on these three points.” Does this mention provide added value? The issue was not resolved at the hearing.

For the prosecution, deception involves fraudulent maneuvers, lies, artifices, tricks which are not found in the file. The defendant’s lawyer was delighted: “No element constituting deception is found in the file and no contradictory expertise of the vehicle is produced by the complainant”. He says he is challenged by the timing chosen by the latter who only filed a complaint on August 13, 2020 and who, today, is demanding €20,000 from the defendant who is not happy with the following writing from the complainant: “In the absence of payment, your reputation will suffer.”
