The principle of social security was one of the concepts that was most repeated at the beginning of the debate in the room of the project known as the short isapres law, which is undergoing its first process in the Senate.

By agreement of the Committees, next Monday, January 29, the discussion will resume to proceed to the general vote. Then the articles will be voted on with the indications provided by the Executive and the legislators. The idea is that the Lower House begins its processing once the legislative recess returns.

The norm – initiated in a message – which was previously known by the Health and Finance commissions, aims to make it feasible to comply with the ruling of the Supreme Court that forces the Isapres to apply the single table of risk factors and return the charges in excess. Likewise, new powers are given to the Health Superintendency and the National Health Fund (Fonasa) is strengthened with the creation of the new Complementary Coverage Modality (MCC).

In the ordinary session held this week, the president of the Health Commission, Juan Luis Castro, recounted the work of the body developed for eight months. “We received more than 30 actors from the world of public health, Isapres, the Executive, representatives of Espacio Público, and the Faculty of Economics and Business of the University of Chile. An Advisory Committee was even formed that worked for four months on a not easy task, which is to make compliance with sentences compatible with the financial balance of the industry,” he explained.

“However, the project states that insurers must present a repayment plan, determine the amounts charged in excess that will not be part of their rates, and establish conditions for the withdrawal of profits and criminal sanctions for uneconomic conduct,” he noted. recalling the most debated matters in the Commission such as the determination of liabilities and the guarantee of continuity of treatments.

Then, the president of the Finance Commission, Senator Ricardo Lagos, referred to the changes introduced by this body that reviewed the matters within its jurisdiction. “We replaced something rejected by the Health Commission that refers to the well-founded proposal that the Isapres must present for the base prices to the Superintendency and, in turn, it will refer that to the Advisory Council. “We were told that there will be a methodology to develop said plan,” he clarified.

“We also approved another indication that details how the final price is calculated and another, which makes clear Fonasa’s obligation to continue the treatments of members who receive this insurance from an Isapre in insolvency,” he added, addressing the financial report that “ “It would have a lower cost that only refers to the hiring of officials of the MCC and the Advisory Council.”

For her part, the Minister of Health, Ximena Aguilera, assured that “this project seeks to give certainty to people with the MCC, to the health providers who have been affected by this uncertainty, and to the Isapres themselves who will have clear rules to operate.” without the current levels of judicialization (…) In addition, we committed to present before October, a reform project that ends the pre-existing conditions (…) Our objective has never been to end the industry but to comply with the sentences, ensuring the right to health”.
