The Supreme Court of the Russian Federation rejected the first claim of Boris Nadezhdin, which concerned the procedure for collecting signatures. About it reported in the telegram channel of politics.
RIA Novosti clarifiesthat Nadezhdin disputed the Central Election Commission’s requirement that the lists of signature collectors be certified by a notary of a certain region, so they cannot collect them in another subject. The politician noted that the Central Electoral Commission did not recognize signatures collected in Moscow from residents of other regions by collectors who were not registered in the region of residence of the signatories.
“The collector who collected signatures in Moscow for the signature sheet of the Krasnodar Territory was not required to go to Sochi to a notary for certification… The federal law does not contain a requirement due to which the Central Election Commission rejected the signatures. It was in this provision that the commission exceeded its powers. The CEC additionally imposes obligations on the collector to obtain notarization several times – for each region from which he collected signatures. He should also have been included in the list of collectors several times. Moreover, according to the defendant himself, such a requirement is not contained in federal law,” explained Nadezhdin at the meeting.
Nadezhdin’s second claim concerns the form of the signature sheet verification sheet, which does not contain the conclusion of a handwriting expert.
“The conclusion must contain all the expert’s data – full name, education data, the corresponding license, an indication of the specific signature – the line, sheet and folder in which it is located. As well as a description of the specific reasons why a particular signature is considered invalid. 4565 of your signatures were rejected by handwriting experts. But we did not receive any conclusion that would confirm that this was justified,” the politician noted.
Update. Nadezhdin’s second lawsuit was also diverted. “I am going to appeal both decisions, and I will also file the main claim in court – to challenge the refusal of my registration. I do not give up and will not give up,” said the politician.
On February 16, Nadezhdin plans to file a third lawsuit in the Supreme Court – to challenge the CEC’s decision to refuse to register him in the Russian presidential elections. He explainedthat in order to challenge a denial of registration, it is necessary to contact thousands of citizens across the country. This takes time, so the main lawsuit will be filed later than the first two.
On February 8, the Russian Central Election Commission did not register Boris Nadezhdin as a candidate for the presidential election. After checking 60 thousand signatures, the commission invalidated 9147 signatures.
