The Spanish Supreme Court has confirmed that Portuguese coach José Mourinho must pay a substantial fine of 1.3 million euros in connection with the tax regularization of the Personal Income Tax (IRPF) for the years 2011 and 2012, the period when he was at the head of Real Madrid.

In 2018, the Tribunal Central Económico Administrativo rejected his request relating to IRPF for the period 2010-2012, leading to a tax fine of 571,073 euros and a settlement of 881,368 euros.
Subsequently, the National Court of Appeal annulled the sanction and declared the Administration’s right to determine the tax debt for the year 2010 to be prescribed, but maintained that of the years 2011 and 2012. Mourinho had contested the regularizations of these two years, arguing that the economic court had incorrectly assessed the taxation of payments received for his mediation in his contract with Real Madrid.
Supreme Court rejects Special One’s appeal
Specifically, he claimed that these payments might not be considered his income, because it was not proven that the club paid to agent Jorge Mendes’ company Gestifute on his behalf. Rather, he maintained that it was Real Madrid which requested the services of this company and paid accordingly.
However, the Administrative Disputes Section of the Supreme Court rejected his appeal, forcing him to finalize the regulations for the years 2011 and 2012. It emphasizes that no income was declared by the coach on these payments and that no omissions from the Tax Administration were noted at that time. The Court insists on the fact that no negligence was noted, especially given the fact that it is only following a corresponding legal qualification carried out by the inspection, concerning the sums paid without withholding, that the obligation to withhold these amounts by the payer has been established.
