Yudha Arfandi Named Suspect in Death of Dante, Tamara Tyasmara’s Daughter: Child Protection Laws and Criminal Code

The police officially named Yudha Arfandi (33) as a suspect in the death case Dante (6), daughter of artist Tamara Tyasmara. Yudha was charged with premeditated murder.

“As intended in Article 76 C in conjunction with Article 80 of Law Number 35 of 2014 concerning Child Protection. Then, Article 340 of the Criminal Code, Article 338 of the Criminal Code, Article 359 of the Criminal Code,” said the Director of Crime and Crime of Polda Metro Jaya Kombes Wira Satya Triputra to journalists, Monday ( 12/2/2024).

Article 76C of Law Number 35 reads:

Every person is prohibited from placing, allowing, committing, ordering or participating in violence once morest children

Article 80 of Law Number 35 reads:

(1) Every person who violates the provisions as intended in Article 76C, shall be punished with imprisonment for a maximum of 3 (three) years and 6 (six) months and/or a fine of a maximum of IDR 72 million.
(2) If the child as referred to in paragraph (1) is seriously injured, the perpetrator shall be punished with imprisonment for a maximum of 5 (five) years and/or a fine of a maximum of IDR 100 million.

(3) In the event that the child as referred to in paragraph (2) dies, the perpetrator shall be punished with imprisonment for a maximum of 15 (fifteen) years and/or a fine of a maximum of IDR 3 billion.
(4) The penalty is increased by one third of the provisions as referred to in paragraph (1), paragraph (2), and paragraph if the person carrying out the abuse is the parent.

Article 338 of the Criminal Code reads:

Anyone who intentionally takes the life of another person is threatened with murder with a maximum imprisonment of fifteen years

Article 340 of the Criminal Code reads:

Anyone who deliberately and with premeditation takes the life of another person, is threatened, because of premeditated murder (moord), with the death penalty or life imprisonment or for a certain period, a maximum of twenty years

Article 359 of the Criminal Code reads:
Any person who, through negligence, causes another person to die, shall be punished with a maximum imprisonment of five yearsjara

Dante Tries to Save Himself but is Failed

The police revealed that Dante (6), Tamara Tyasmara’s son, had tried to save himself following being allegedly drowned by Yudha Arfandi, who was none other than Tamara’s lover. However, Yudha thwarted this.

“Then, the victim tried to swim to the edge of the pool, but the suspect made suspicious movements so that the victim might not reach the edge of the pool,” said Dirkrimsus Polda Metro Jaya Kombes Wira Satya Triputra to reporters, Monday (12/2/2024).

Afterwards, the suspect lifted the victim to the edge of the pool and provided assistance. At that time the victim was not breathing and was emitting foam and food residue from his mouth.

“Next, the suspect lifted the victim and placed him on the edge of the pool. After the victim was given first aid by witnesses in the swimming pool, it was discovered that the victim was not breathing,” he said.
