In a recent statement, Birahim Seck, a prominent figure in Senegalese civil society, sparked a heated debate by questioning the fundamental principle of the separation of powers. At the heart of this controversy is the proposal from the Union of Senegalese Magistrates (UMS) to summon members of the Constitutional Council before a Parliamentary Commission of Inquiry.

“The principle of the separation of powers raised by the Union of Senegalese Magistrates (UMS) is not enough to avoid hearing members of the Constitutional Council by a Parliamentary Commission of Inquiry. Magistrates can hear members of the national assembly and the executive, reciprocity should be required in a democracy. Finally, if the magistrates want to relinquish control of the National Assembly, they know what to do.” says Birahim Seck.

This position raises crucial questions regarding the nature of Senegalese democracy and the functioning of its institutions. Traditionally, the separation of powers has been considered a fundamental pillar of any democracy, aimed at ensuring a balance of powers and preventing abuse of power. However, Seck’s proposal highlights the limits of this principle and suggests that a strict interpretation might hinder accountability and transparency.
