Ditec Automobiles Marketing, official representative and importer of Porsche, Volvo and Jaguar Land Rover, filed a complaint last week once morest a former employee for the alleged crimes of fraud, computer fraud and aggravated theft.

According to the document, presented before the Fourth Guarantee Court of Santiago, the defendant Victor Chamorro served in the company from October 12, 2021 to October 26, 2023, in the position of service advisor for Jaguar Land Rover in the sales and technical service branch of La Dehesa. Within the infrastructure of the branch, the company has a warehouse, where spare parts are stored for the correct operation of the workshop.

At the end of last year, Ditec management received an internal complaint through the Speak Up channel, stating that in the Jaguar Land Rover “JLR” Lo Barnechea workshop, there were oil temperature sensors with erased lines, spare parts physically delivered and without associated payments.

Since 2022, Ditec is part of the Inchcape group, the main independent multi-brand global automotive distributor, present in 12 markets in America.

As a result of the case, the company began an investigation into alleged irregularities and detected the existence of 82 work orders in 2022 in which the defendant eliminated 186 spare parts with a total value of $36,465,446, also eliminating other items corresponding to labor. and workshop income of $18,697,129.

“The defendant, in 21 work orders in 2023, eliminated a total of 69 spare parts, with a value of $19,850,022, made 6 unauthorized discounts for $1,212,008 and 9 unauthorized discounts in labor for $1,099,737. ″. He added the criminal action sponsored by lawyers Catalina Navarro and Carlos Vernaza, partners of Estudio Navarro Abogados.

“The defendant created sales notes in the SAP system indicating the total number of spare parts loaded to the respective work order, with which the items were removed from the warehouse of the JLR (Jaguar Land Rover) branch in Lo Barnechea. Then the defendant logged in from his computer with his Windows user (vchamorro) and improperly accessed the SAP system with the user (rherrera) belonging to the sales manager of Jaguar Land Rover, Ditec, Roberto Herrera, modifying the sales notes, eliminating parts of spare parts or labor and applying discounts on unauthorized spare parts and labor,” the letter stated.

Once the modifications were made, the defendant closed the sales note once more for its respective billing, leaving the parts and spare parts eliminated, and therefore not invoiced, in a SAP account called “virtual warehouse” as warehouse orders or work orders. in progress.

In this way, it was found that there were uninvoiced spare parts and pieces, which were registered in the system as orders in progress, in the “virtual warehouse”, which, however, were removed from the physical warehouse of the JLR branch in Lo Barnechea, without being invoiced and paid, causing financial damage to the complainant company. Likewise, according to Ditec “it was established that income was eliminated for labor that was not received and unauthorized discounts were applied for amounts that, consequently, were not invoiced or received.”

The internal investigation carried out by the company established that the defendant, Víctor Chamorro, is the owner of a company V&C Motors SpA, which provides vehicle maintenance and repair services at home, directly in customers’ homes, a situation that was unknown to the company. company.

According to the company, “the above explains the theft of spare parts that appear to have been delivered directly to said addresses on at least one occasion; as well as the application of discounts and elimination of labor for the work, all for your own and exclusive benefit and that of your company.”

Ditec explained to Pulso that “the reference event points to a specific situation in which a worker made sales and discounts without authorization and to the detriment of the company, which led to measures being taken immediately in accordance with our Code of Conduct.” . And he added: “the worker was dismissed and a lawsuit was filed. As the incident is in the hands of justice, we cannot provide more details.”
