The defendant Mr. Dia did not appear for his trial before the Dakar criminal court. He had been responsible for finding in favor of Mr. Y. Kébé and his associate a cargo of fish worth 7 million FCFA. After pocketing the money from the order, Mr. Dia simply melted away. He has not been found since the sum was handed over.
In the plaintiffs’ statements, the defendant stated the impossibility of taking possession of the ordered cargo and refused to return the money. Before the bar, the civil party returned to the facts.
“The relationship between us and Mr. Dia concerns the purchase and sale of fish products. When he told me he mightn’t have the shipment, I asked him to give me the money back but so far I haven’t been able to get our due. This money belongs to both of us because we share the same business. The order belongs to a customer,” Y. Kébé argued in front of his partner who also came to take part in the trial.
It appears from the court proceedings that the complainants were arrested by the search brigade for non-compliance with the order before being released.
“We were asked to reimburse the 7 million FCFA that we paid to Mr. Dia for the goods and we made commitments to the investigators, which is why we were released,” argued Y’s associate. Kebe.
In his requisition, the prosecutor attested to the materiality of the facts of breach of trust and requested 6 months of imprisonment once morest Mr. Dia, the absentee most present before the correctional chamber.
The civil party, for its part, demonstrated the guilt of the accused.
“The amount was returned but worse, Mr. Dia caused harm to my clients who were arrested and detained and this prevented them from working. For all this, we are asking for 3 million FCFA beyond the repayment of the sum of 7 million FCFA, that is to say 10 million FCFA for any cause of damage suffered,” pleaded the council. According to the lawyer, Mr. Dia is solely responsible and must be arrested and detained.
“Since the preliminary investigations, Mr. Dia has refused to appear. We cannot commit a crime and avoid responsibility,” explained the civil party’s lawyer.
