Before the closing of 2023, the Superior Court of Justice got into a thorny issue: the exercise of teaching. By agreement, it dictated a series of rules that in fact imply greater control over judges who work in universities. In rock, The issue generated controversy with magistrates who had to leave their chairs due to complaints from female students.

The agreed upon 30 of the STJ was signed on Thursday, December 28 and at that time it went unnoticed. The rule was issued within the government powers of the highest judicial court: the agreements are equivalent to sessions of the legislature.

Although the norm does not state the number of judges and officials who teach, the number has grown since the National University of Río Negro was installed in Viedma. Originally, the Roca law school was the academic cradle of high-ranking officials. In fact, the STJ judge himself Sergio Barotto was dean of the University of Comahue before moving to the Judiciary.

The agreed statement that article 201 of the Provincial Constitution prohibits magistrates and judicial officials “exercise a profession or employment, with the exception of teaching or research, according to the regulations.” And that is why it is regulated accordingly.

In 2003, the STJ, with another integration, had made an attempt to regulate the practice of teaching and at that time repealed all authorizations. But Currently, there is no reliable record of personnel who have teaching tasks, nor have the conditions been established under which – in principle – the tasks that are compatible with the judicial function can be carried out.

It is noted in the agreement that carrying out academic activities entails a workload of such magnitude that it puts at risk the dedication and personal commitment of the judiciary, the civil servant or the judicial employee to their obligations and duties within the Judicial Branch.

In good romance, situations were detected in which officials dedicate more time to the academy than to the exercise of their function. For this reason, an entire control mechanism was established, a registry, prohibitions and sanctions for non-compliance.

Last year, the links between the university and the judiciary were in the eye of the storm due to the complaint once morest criminal judge Gastón Martín de Roca. The magistrate had been a teacher and his departure from the faculty occurred under unclear circumstances.

This medium inquired with university authorities but no one wanted to confirm the rumors. Another judge, Daniel Tobares, also accused of sexual abuse, stopped being a teacher in a context surrounded by suspicions for alleged links with female students.
