The Ministry of Health filed a lawsuit once morest 21 EPS before the Contentious Administrative Court of Bogotá, arguing that these entities would be violating the right to social health security.
This is seen in the document in the hands of EL TIEMPO, it is signed by the legal director of the Minsalud, Rodolfo Enrique Salas, and details that by instruction of Minister Guillermo Alfonso Jaramillo this judicial action is proceeded, considering that the EPS would be violating different rights.
The rights that the EPS are accused of having violated or threatened are “the defense of public assets, administrative morality and access to the public service to social security in health and that its provision is efficient and timely,” says the demand.
In this way, the ministry intends that immediate actions be ordered to these entities “in order to fully comply with the constitution and investment of technical reserves, to guarantee known and unknown pending obligations, considering not only the current periods and future periods, but also those periods unfulfilled previously; in an effort to guarantee the fundamental right to health and its due provision to the inhabitants of the national territory and thus, put an end to the serious impact that collective rights and interests are currently experiencing.”
According to what the Ministry stated in the lawsuit, the provision of EPS services in terms of health insurance would be at risk considering that these entities do not comply with different financial requirements established by the Superintendency of Health.
